SCOTUS heard arguments about nationwide injunctions as part of the birthright citizenship case. They have a chance to finally rein in the lower courts, but will they?
Doesn't sound like we have anything to be hopeful about. Just can't understand how we got to this place. Haven't those lower court judges taken it upon themselves to deny the authority of the Executive, i.e. POTUS? If so, what's the Separation of Powers for and why wouldn't it weigh in on the decision by the SCOTUS Justices?
That’s truly the crux of the issue before yesterday’s Court. I’m not sure how Birthright Citizenship developed precedence in the hearing. The other 40 injunctions by the inferior courts interfere with the Title II responsibilities the President hold for the wellbeing of the nation, and specifically keeping us safe. I see no reason for district judges interference.
The birthright citizenship has been called illegal, but there is so much depth to it, in history, in precedent, in Constitutional wording. The High Court needs to study this well before any decision, especially the 1860-65 amendments and the 1890–1952 cases. Listening to Sotomayor’s understanding was appalling.
If this goes against DJT, the conservative lawyers better start FLOODING the courts with suits against every Lib lawmaker in the country. What’s good for the goose is good for the gander!
