Obama-Appointed Federal Judge Rules Illegal Immigrants Can Carry Guns
The issue is about we the people, the people who comprise the republic, the people through which elected officials and their appointments derive authority.
Heriberto Carbajal-Flores entered the country illegally and in 2020 was caught carrying a handgun that he said he obtained for self-protection during the George Floyd-era riots. Earlier this month a leftist judge ruled that he and other illegal aliens can carry firearms legally.
This all concerns more laws than just entering the United States legally. How did this illegal alien obtain his firearm? In his state where he illegally resided? In another state in which he wasn’t illegally residing? Whether or not you support or oppose background checks is irrelevant to current law regarding obtaining a firearm. As is, purchasing a handgun in a state where you don’t live requires transferring the purchase through an FFL where you’ll complete a background check to conclude the sale. You’re legally able to purchase a handgun in your state of residence provided that you’re not a prohibited person. Carbajal-Flores is prohibited person as defined by 18 U.S.C. § 922(g), which specifically points to the ineligibility of illegal aliens.
The left (and some of the leftist-right) disingenuously argues that denying someone their Second Amendment right based on whether or not they are in the U.S. legally “others” them and is “racist” — and whatever other deflective, DEI word salad chum they’ve been conditioned to spit out as bait to hook unsuspecting 2A supporters into defending either open borders or advocating for gun control.
You have to give the left some credit as they’ve spent years fighting to disarm minorities — even to the extent of arguing (covered in my first book), as Chief Justice Roger Taney shamefully did in Dred Scott v. Sandford, that recognition of black Americans would automatically affirm their Second Amendment rights, thus they cannot be considered persons the same as everyone else. Carbajal-Flores’s case isn’t one where citizenship was denied, he didn’t even ask for it. He entered illegally and was caught carrying a gun.
Yes, the Constitution affirms the natural rights of US citizens, we the people. However, if you want your rights affirmed, become a citizen and start by entering legally.

Ours isn’t a monarchy where a single sovereign leads; in our republic the people are the sovereignty. Those outside of the republic cannot lay claim to the protections of it. Sadly, in this upside-down world we’re watching American jurisprudence degraded to the point where even the legal definition of “woman” is under attack.
How can a person that is not a US citizen able to carry? Illegally comes to mine. This Judge is on something.
It doesn't get any better with these leftwing nut jobs. American citizens have to go through hell to get firearms and constant attacks on the second amendment yet it's okay for illegal immigrants to get firearms. The party of satan spares no punches promoting their bulls. t.
