Last Week In Legal: Hurry Up and Wait Edition
Hunter may have a valid point; several of Trump's cases are stuck in holding patterns; Menendez's funding has dried up.
Hunter Biden Legal Troubles
Hunter’s legal team submitted their replies to the government’s attempts to shoot down their various motions to dismiss. One of the many attempts to get the case dismissed alleged that the case was invalid because Special Counsel David Weiss was illegally appointed. They are right about that. The law clearly states that a Special Counsel has to be someone from OUTSIDE the government. David Weiss still works for the DOJ as the Deleware US Attorney. This is a problem for both this case and the tax case in California. In the government’s response, Weiss tried to use a history lesson about the DOJ to obfuscate the point. Hunter’s response just absolutely torches “Special Counsel” Weiss.

Trump announced he is looking for a new law firm to handle the appeal. Meanwhile, a New York Post story came out claiming to have a source in the law firm that Judge Kaplan and EJC lawyer Roberta Kaplan (no relation) had both worked at the same law firm for two years in the early ‘90s. The source claimed that the two Kaplans were close and that the judge had acted as a mentor for the younger lawyer. This story prompted lawyer Habba to write a letter to the judge requesting him to clarify the matter and intimating that his blatant hostility towards the defense council in both cases was grounds for appeal. Ms. Kaplan fired off her own letter, accusing Habba of peddling “false allegations” and denying that the two Kaplans had ever interacted while they both worked at the large firm. She also reserved the right to file sanctions against Habba. Habba quickly responded by clarifying that she did no such thing and declaring she would drop the matter.
While all these letters were flying back and forth, EJC’s lawyers went on the George Conway podcast* to spill all the tea about Trump and Habba.
*EJC has previously admitted in court that she only sued after Conway suggested it and introduced her to LinkedIn Founder (and former Nikki Haley donor) Reid Hoffman, who bankrolled the case.
